Terms of Service
Preamble
These Terms of Service (the “Terms”) govern access to and use of the Nomad mobile application, the website nomadtravel.guru, and related cloud services (together, the “Service”) by the user (the “User”).
The Service is operated by Stackhouse as provider (the “Provider”). Use of the Service constitutes full acceptance of these Terms. If you do not accept them, do not create an account or use Nomad Cloud.
The current Terms are published at https://nomadtravel.guru/en/terms/. The privacy and personal-data notice (the “Disclaimer” or “Privacy Notice”), which forms part of the legal documentation but exclusively governs personal-data processing, is always the latest published revision at https://nomadtravel.guru/en/privacy/ and, in the App, the text bound to the calendar version shown there. If these Terms and the Privacy Notice conflict on personal data, the Privacy Notice prevails.
Definitions
Unless the context requires otherwise: “App” means the Nomad mobile application; “Site” means nomadtravel.guru and its pages; “Account” means the credentials and profile associated with the User; “User Content” means text, places, dates, lists, expenses, attachment metadata, and any other material entered or uploaded by the User or trip companions; “Nomad Cloud” means server-side sync and storage; “Companion” means another user expressly invited to a trip.
References to statutes are to those instruments as in force from time to time.
The Service
Nomad is a trip-organisation tool: it lets you build itineraries, record stops, manage lists, expenses, and companions, and sync that information across your devices and, within visibility settings, with Companions.
The Service is provided “as is” as to features available from time to time. Some functions (maps, notifications, federated authentication, telemetry) depend on third parties and may be unavailable in a given jurisdiction or configuration.
The Provider may change, suspend, or retire features, with reasonable notice where the change is material and not required for security or law.
Capacity and requirements
You represent that you have legal capacity to bind yourself to these Terms. If a minor uses the Service, use is permitted only with the consent and under the responsibility of the holder of parental responsibility, within the limits of law.
You are responsible for complying with the laws of the place where you are, including export, sanctions, and unlawful-content rules.
Account, credentials, and security
To use Nomad Cloud you must create an Account, verify your email where required, and keep credentials confidential. You are responsible for all activity through your Account, unless you prove abusive use not attributable to you after prompt notice.
Federated sign-in (Apple, Google) is also governed by those providers’ terms. The Provider is not a party to those relationships.
You must not assign, share, or circumvent Account controls. The Provider may suspend or terminate in case of breach, security risk, or a binding order.
Licence
The Provider grants you a personal, non-exclusive, non-transferable, revocable, limited licence to access and use the Service for personal or household trip purposes, in accordance with these Terms.
You must not: (i) copy, modify, decompile, or circumvent technical measures, except where mandatory law allows; (ii) use the Service to provide a competing service; (iii) scrape, probe, or place unreasonable load on the infrastructure; (iv) remove trademarks or proprietary notices.
Nothing transfers to you intellectual-property rights in the Service, the Nomad mark, software, or documentation, save the licence in User Content below.
User Content
You retain ownership of your User Content. By entering it into the Service, you grant the Provider a worldwide, non-exclusive, royalty-free licence, for as long as needed, to host, sync, back up, display, and transmit that Content solely to provide the Service to you and authorised Companions.
You represent and warrant that you have the rights needed in the Content and that it does not infringe third-party rights or mandatory law. Companions see only what you expressly share.
The Provider does not generally monitor Content and has no general monitoring obligation. It may nonetheless remove or restrict Content that is manifestly unlawful or in breach of these Terms, on notice or a binding order, in line with intermediary-service rules where they apply.
Acceptable use
You must not: upload malware; attempt unauthorised access; interfere with the integrity or performance of the Service; use the Service for unlawful, harassing, defamatory, or child-harmful activity; enter third-party data without a legal basis; circumvent technical limits, quotas, or security; or resell the Service without written agreement.
Breach is a material default and justifies immediate suspension, without prejudice to other remedies.
Personal data and referral to the Privacy Notice (Disclaimer)
Processing of personal data is governed exclusively by the Privacy Notice, which you must read. The current Notice — always the latest published revision — is available in the App and at the permanent address:

These Terms are not a second privacy notice. Every description of statistical analysis, telemetry, Google Analytics, recipients, extra-EEA transfers, and data-subject rights in the Notice is incorporated by reference.
You acknowledge that: (i) first-party internal statistics are processed in aggregated, non-identifying form, as set out in the Notice; (ii) product telemetry via Google Analytics 4, where enabled, is not anonymous processing in the legal sense and is described transparently in the Notice.
Availability, changes, and disclaimer of warranties
The Provider uses reasonable efforts to keep the Service available, without warranting uninterrupted operation, freedom from errors, or fitness for a particular purpose. Maintenance, force majeure, and third-party failures (stores, maps, authentication, your network) may cause interruptions.
To the maximum extent permitted by mandatory law, the Service is provided “as is” and “as available”, without implied warranties of merchantability, non-infringement, or accuracy of content (including third-party maps and geocoding).
Provider intellectual property
Trade marks, logos, interface, code, documentation, and original Provider content are reserved. Unauthorised use is prohibited. Product suggestions you submit may be used by the Provider without compensation, without prejudice to your rights in your User Content.
Limitation of liability
Within the mandatory limits of consumer law and tort, the Provider is not liable for: (i) indirect damage, loss of profit, loss of data on your device, or damage from third-party default; (ii) Content entered by you or Companions; (iii) travel decisions based on information in the Service.
In any event, the Provider’s aggregate liability to you for Service-related events in any twelve-month period shall not exceed zero euros for the free Service or, if and when fees apply, the amount you paid in that period, except for wilful misconduct or gross negligence and except personal injury for which limitation is void.
Nothing in these Terms excludes liability that the law does not allow to be excluded.
Indemnity
You indemnify and hold the Provider harmless from third-party claims arising from your User Content, from use of the Service in breach of these Terms or law, or from infringement of third-party rights, including reasonable legal costs, except where the harm is exclusively attributable to the Provider.
Withdrawal, suspension, and deletion
You may stop using the Service and request Account deletion under the App procedures and the Privacy Notice. The Provider may suspend or terminate in case of breach, security risk, prolonged inactivity where notified, or Service wind-down, granting where reasonable a window to export Content (.nomad).
Clauses that by nature survive (intellectual property, limitation of liability, governing law, indemnity) remain effective after termination.
Governing law and venue
These Terms are governed by Italian law, without prejudice to mandatory consumer-protection rules of the Member State of your habitual residence where you act as a consumer under EU law.
For consumer disputes, the courts of the consumer’s place of residence or elected domicile have jurisdiction. For Users not acting as consumers, the courts of the place where the Provider has its operational seat have exclusive jurisdiction, without prejudice to mandatory venues.
Amendments
The Provider may amend these Terms by publishing the new version on the Site, identified by a calendar date. Material changes will be notified by reasonable means (including, where relevant, the App). Continued use after the effective date constitutes acceptance, without prejudice to your right to stop using the Service and delete the Account.
